The present text aims to understand the concept of constituent power based on the thought of Toni Negri, exploring the relationships between constituent power and potentiality in his work. The theoretical foundation relies on the author's texts and seeks to answer the following question: to what extent does the concept of constituent power in Toni Negri represent a potentiality for constitutionalism? The general objective is to analyze the main aspects of this issue, identifying the points that converge toward the proposed discussion. To achieve this purpose, the following specific objectives were defined: (1) to identify the concept of constituent power in Toni Negri; (2) to analyze the relationship between the concept of potentiality and the political-law interaction; and (3) to discuss the meaning of potentiality in the context of constituent power. The adopted methodology consists of bibliographic research, allowing for a deeper analysis of Negri's ideas and their theoretical implications. As an expected result, the aim is to highlight that the tension between potentiality and constituent power reflects a dynamic based on the multitude, offering a strategy to understand collective action grounded in the plurality of acts.
